Terms of Service
The short version
- Poppie helps you identify movies and shows from posts and see where they stream. It's usually right, but it can be wrong, and streaming availability changes, so double-check before you pay for anything.
- Subscriptions are billed and renewed by Apple. Cancel anytime in your Apple settings.
- Only share posts you're allowed to share, and don't misuse the Service.
- We're not affiliated with Instagram, TikTok, YouTube, TMDB, JustWatch or any streaming service.
- Disputes go to individual arbitration, not court or class actions (section 16), unless you opt out within 30 days. Please read that section.
The short version is just a summary. The full terms below are what govern.
1. Agreeing to these terms
These Terms of Service ("Terms") are an agreement between you and Poppie ("Poppie," "we," "us") covering your use of the Poppie iPhone app, its share extension, getpoppie.com, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Who can use Poppie
You must be at least 13 years old to use Poppie. If you're under 18 (or the age of majority where you live), you may use Poppie only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf. You must also be legally able to enter into these Terms and not be barred from using the Service under applicable law.
3. Your account
You need an account to use Poppie. Keep your Apple ID and device secure; you're responsible for activity on your account. Tell us right away at help@getpoppie.com if you think someone else has used it. Give us accurate information and keep it up to date.
4. What Poppie does
Poppie lets you share or paste links to public posts, identifies the movies and TV shows they're about, shows where those titles are available to stream, rent or buy, and lets you save them to a library, organize them into lists you can share, and get notified when they become available on your services.
We're always improving Poppie, so features may change, be added or be removed. We may suspend or stop all or part of the Service at any time. If we shut Poppie down entirely, we'll try to give you reasonable notice.
5. Accuracy and AI
Poppie uses automated systems, including artificial intelligence, to read posts and identify titles. These systems can make mistakes: Poppie may pick the wrong title, miss a title, or find nothing at all. Movie and TV information and streaming availability come from third parties (TMDB, with streaming data from JustWatch) and may be incomplete, outdated or wrong. Availability, prices and services change often and vary by region. Always confirm with the streaming service before you subscribe, rent or buy anything. Poppie isn't responsible for decisions you make based on its results.
6. Free finds and subscriptions
- Free finds. Poppie includes a limited number of free finds. A "find" is saving a new title from a post, a link, or a search. We may change what's included for free.
- Poppie Unlimited. Unlimited finds are available through an auto-renewing subscription sold through Apple's App Store. The price and billing period are shown before you buy.
- Billing by Apple. Payment is charged to your Apple ID when you confirm the purchase. Your subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the current period ends.
- Free trials. If you start a free trial, you'll be charged when it ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
- Cancelling. Manage or cancel your subscription in your iPhone's Settings (tap your name, then Subscriptions). Cancelling stops future renewals; you keep access until the end of the period you've paid for. Deleting the app does not cancel your subscription.
- Refunds. Apple handles all payments and refunds under its own policies. Request a refund through Apple at reportaproblem.apple.com. We can't issue refunds directly.
- Price changes. We may change subscription prices. Apple will notify you as required and, where required, ask for your consent before a price increase applies.
7. Rules of the road
You agree not to:
- break any law, or use the Service to infringe or violate anyone else's rights, including intellectual property and privacy rights;
- use Poppie to collect or store other people's personal information without permission, or to harass, threaten or harm anyone;
- name lists, or put anything into the Service, that's unlawful, hateful, harassing, sexually explicit involving minors, or otherwise objectionable;
- use bots, scripts or automated means to access, scrape or overload the Service, or use it to build a competing product or dataset;
- reverse engineer, decompile, or try to get the source code of the app, except where the law expressly allows it;
- interfere with or bypass any security, usage limit, paywall or free-find limit;
- access our servers or APIs except through the app, or share or misuse any keys or credentials;
- resell, sublicense or commercially exploit the Service without our written permission; or
- use Poppie to violate the terms of Instagram, TikTok, YouTube or any other platform.
8. Your content
"Your content" means the links you share, searches, list names, and anything else you add to the Service. You keep whatever rights you have in it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit and display your content only as needed to operate, provide and improve the Service, including showing it to members of lists you share. This license ends when your content is deleted from the Service, except for content you've already shared with others (for example, titles on a shared list) and copies we must keep by law.
You're responsible for your content and promise you have the right to share it with us. Only share links to posts that are publicly available. We don't claim ownership of any post you share; Poppie reads public posts only to identify titles for you.
If you send us ideas, suggestions or feedback, we may use them without restriction or payment to you.
9. Third-party services and content
Poppie works with, links to, and shows content from third parties, including Instagram, TikTok, YouTube, TMDB, JustWatch, Apple, and streaming services. Poppie isn't affiliated with, endorsed by, or sponsored by any of them. All movie and show titles, artwork, logos, trailers and trademarks belong to their owners and are shown for identification and reference. Your use of third-party services is governed by their own terms and privacy policies, and we're not responsible for them, their content, their availability, or anything they do.
Movie and TV data and images are provided by TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB. Streaming availability is provided by JustWatch. Trailers are provided by YouTube and subject to YouTube's Terms of Service.
10. Our intellectual property
The Service, including its software, design, text, graphics, the Poppie name, logo and popcorn characters, belongs to Poppie or its licensors and is protected by intellectual property laws. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the app on Apple devices you own or control, for your own non-commercial use. We reserve all rights not expressly granted.
11. Copyright complaints
We respect intellectual property. If you believe content in the Service infringes your copyright, email help@getpoppie.com with: your contact information; a description of the work; where the material appears in the Service; a statement that you have a good-faith belief the use isn't authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner; and your physical or electronic signature. We may remove content and disable the accounts of repeat infringers.
12. Ending your use
You can stop using Poppie anytime and delete your account in the app (Settings → Privacy → Delete my account), or by emailing help@getpoppie.com. We may suspend or end your access, with or without notice, if you break these Terms, create risk or legal exposure for us or others, or if we stop offering the Service. Sections that by their nature should survive (including 8, 9, 10 and 13 through 20) survive termination. Ending your account doesn't cancel an Apple subscription; cancel that through Apple.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, POPPIE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT RESULTS (INCLUDING TITLE IDENTIFICATIONS AND STREAMING AVAILABILITY) WILL BE ACCURATE, COMPLETE OR CURRENT, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.
Some places don't allow the exclusion of certain warranties, so some of the above may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, POPPIE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $50.
These limits apply to any theory of liability (contract, tort, negligence, strict liability or otherwise) and even if a remedy fails of its essential purpose. Some places don't allow some of these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that can't be limited by law.
15. Indemnity
To the extent allowed by law, you agree to defend, indemnify and hold harmless Poppie and its owners, officers, employees and contractors from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your content, your use or misuse of the Service, or your breach of these Terms or of anyone's rights.
16. Disputes and arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court and to bring or join a class action.
Talk to us first
Before starting arbitration or a lawsuit, you and Poppie agree to try to resolve any dispute informally. Send a written description of the dispute and what you want to help@getpoppie.com (we'll send ours to the email on your account). If it isn't resolved within 60 days, either side may start formal proceedings. Time limits for bringing a claim are paused during this period.
Binding individual arbitration
Except as described below, any dispute, claim or controversy between you and Poppie arising out of or relating to the Service or these Terms ("Dispute") will be resolved by binding individual arbitration, not in court. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, as modified by these Terms, before a single arbitrator. The Federal Arbitration Act governs this section. The arbitrator decides all issues, except that a court decides questions about the scope, enforceability, or formation of this section and the class-action waiver. Arbitration may be held by video or phone, or in person in the county where you live or in New York County, New York. Payment of filing, administration and arbitrator fees will follow the AAA's consumer rules. The arbitrator may award the same individual relief a court could, but only to you individually and only as needed for your individual claim.
Exceptions
Either side may bring an individual claim in small claims court if it qualifies, and either side may ask a court for an injunction to stop infringement or misuse of intellectual property.
No class actions
YOU AND POPPIE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND THERE WILL BE NO JURY TRIAL.
If this class-action waiver is found unenforceable for a particular claim, then that claim (and only that claim) must be severed and decided in court, after all individual arbitrations are complete.
Mass filings
If 25 or more similar arbitration demands are filed against Poppie by or with the help of the same or coordinated counsel, they'll be administered in batches of up to 25 under the AAA's Mass Arbitration rules, and the parties will cooperate in good faith to resolve them efficiently.
Your right to opt out
You can opt out of this arbitration agreement by emailing help@getpoppie.com within 30 days of first accepting these Terms, with the subject "Arbitration opt-out" and your name and account email. Opting out won't affect anything else in these Terms.
Changes to this section
If we change this section, the change won't apply to a Dispute you've already told us about.
17. Governing law and venue
These Terms are governed by the laws of the State of New York and applicable US federal law, without regard to conflict-of-law rules. For any Dispute that isn't subject to arbitration, you and Poppie agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York. If you're a consumer living outside the US, you may also have rights under the mandatory laws of your country that these Terms don't override.
18. Apple terms
If you got Poppie from Apple's App Store, you and Poppie acknowledge that:
- These Terms are between you and Poppie only, not Apple, and Poppie (not Apple) is solely responsible for the app and its content.
- Your license to use the app is limited to using it on Apple-branded products you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are Poppie's responsibility, to the extent not disclaimed in these Terms.
- Poppie, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims the app or your possession and use of it infringes that party's intellectual property rights, Poppie, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you're not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties.
- Questions, complaints or claims about the app should be sent to Poppie at help@getpoppie.com.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
19. Changes to these terms
We may update these Terms from time to time. We'll post the new version here with a new "Last updated" date. If a change is material, we'll notify you in the app or by email before it takes effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you don't agree, stop using the Service.
20. General
These Terms and our Privacy Policy are the entire agreement between you and Poppie about the Service and replace any earlier agreements. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not assign or transfer these Terms without our consent; we may assign them, including in connection with a merger, acquisition or sale of assets. We're not liable for delays or failures caused by events beyond our reasonable control. Nothing in these Terms creates a partnership, employment or agency relationship. Notices to you may be sent by email or in the app. Section headings and the short version are for convenience only.
